Ancient dialectic started as an art of refutation and evolved into a science akin to our logic, grammar and linguistics. Scholars of ancient philosophy have traditionally focused on Plato's and Aristotle's dialectic without paying much attention to the diverse conceptions and uses of dialectic presented by philosophers after the classical period. To bridge this gap, this volume aims at a comprehensive understanding of the competing Hellenistic and Imperial definitions of dialectic and their connections with those of (...) the classical period. It starts from the Megaric school of the fourth century BCE and the early Peripatetics, via Epicurus, the Stoics, the Academic sceptics and Cicero, to Sextus Empiricus and Galen in the second century CE. The philosophical foundations and various uses of dialectic are closely analysed and systematically examined together with the numerous objections that were raised against them. (shrink)

This article offers a reading of Eriugena’s thought that is inspired by Heidegger’s claim according to which being is constituted in a dialectical interplay of revelation and concealment. Beginning with an analysis of how “causality as concealing revelation” works on the level of God’s inner-Trinitarian life, the piece moves on to a consideration of the way in which the human soul reveals itself in successive stages of exteriorization that culminate in the creation of the body, its “image.” The body, (...) however, conceals as much as it reveals true human nature. Moreover, it is shown that for Eriugena all of reality, as theophany, possesses this character of concealing its fundamental truth. These insights lead Eriugena to a recognition of radical human finitude, as genuine wisdom requires an acknowledgement of our fundamental ignorance. (shrink)

Diverse voices explore the possibility of doing metaphysics in light of contemporary critiques.

This book develops an account of the parent–child relationship in order to articulate the essential structure of intersubjectivity as fundamentally ethically-oriented, dialogical, and mutually dynamic. Drawing on the philosophical projects of Maurice Merleau-Ponty and Emmanuel Levinas, as well as recent research in cognitive neuroscience and child development research, this work will be of interest to those working in the fields of continental philosophy, embodied cognition, philosophy of childhood, psychoanalysis, psychology, philosophy for children, and education.

This paper aims to clarify Merleau-Ponty’s difficult concept of “reversibility” by interpreting it as resuming the dialectical critique of the rationalist and empiricist tradition that informs Merleau-Ponty’s earlier work. The focus is on reversibility in “Eye and Mind,” as dismantling the traditional dualism of activity and passivity. This clarification also puts reversibility in continuity with the Phenomenology’s appropriation of Kant, letting us note an affiliation between Merleau-Ponty’s reversibility and Heidegger’s Ereignis: in each case being itself already performs the operation (...) that Kant had located in the imagination. The scope of my considerations here is defined along two lines, which seem to me of essential relevance for a theory of dialectic. On the one hand, the form of negation that – as self-referring antinomical negation – gains a quasi-semantic expulsory force [Sprengkraft] and therewith a forwarding [weiterverweisenden] character; on the other hand, the notion that every logical category is defective insofar as the explicit meaning of a category does not express everything that is already implicitly presupposed for (...) its meaning. Both lines are tightly interwoven. This I would like to demonstrate with the example of the dialectic of Being and Non-Being at the beginning of the Hegelian Logic. I will first make visible the basic structures of dialectical argumentation (sections II and III) – whereby certain revisions will turn out to be necessary in comparison with Hegel’s actual argument. Thereby it proves essential that the whole apparatus of logical categories and principles must be always already available and utilized for the dialectical explication: proving dialectic as a self-explication of logic by logical means: dialectic, as it were, as the self-fulfillment of logic (sections IV–VI). The aim of this hermeneutic study was to gain a broader understanding of nurses’ workload and what characterizes a nurse’s experience in terms of the various levels of intensity of nursing care. Twenty-nine nurses participated in seven focus groups. The interpretation process took place in six different phases and the three laws of dialectics were used as interpretation rules. An optimal nursing care intensity level can be understood as a situation characterized by the balance between the intensity of care needed (...) by patients and the external and internal factors of the current nursing care situation. The nurses’ work situation can be understood as a dialectic struggle between ‘being’ and ‘not being’ a good nurse; this can be said to be the underlying root metaphor. Nursing care can be understood as consisting of ‘complex and meaningful caring situations’. Dialectics can be used as a fruitful method of revealing the complexity of clinical reality. (shrink)

In this article I argue that Nietzsche resorts to a typical, ambitious Young Hegelian dialectical grand narrative to dramatically frame Modernity, elevate his own critical theory to unmatchable heights and find for himself a superior, unique position as Critic and Destiny, having as his main enemy the philistines (common human beings), and that which politically corresponds to them: civil society and democracy. Nietzsche’s epochal narrative exhibits a classical dialectical progression from Error/Negation, through Escalation, to Crisis, then Negation of Negation (Inversion), (...) and promised New Age, all of which entails the unwelcome consequences of self-aggrandizing exaggerations, determinism, negativism, binarism, otherworldliness, transhuman idealizations, and racial-caste-hierarchism that compromise the otherwise interesting side of his critical suggestions, once deflated, on culture and morality. In connection with the discussion on the problem of logic, both within our country and abroad , it has already turned from the general, comparatively abstract, and difficult-to-resolve problem of the "relationship between formal logic and dialectics" to the more concrete problem of the functional scope of formal logic. Some people have even utilized special articles to inquire about a certain law in formal logic: the functional scope of the law of identity or the law of contradiction. The purpose of (...) these philosophers or logicians is to try to define the functional scope of a certain law in formal logic as a starting point, and then to proceed to study the functional scope of formal logic in the entire thinking process of mankind. If the functional scope of formal logic in mankind's entire thinking process is clearly and precisely defined, the solution of this complicated problem of the "relationship between formal logic and dialectics" would certainly not be very difficult. The basic purpose of Comrade Chu-ko Yin-t'ung's article on the problem of "whether or not formal logic's law of contradiction can be contravened in the dialectical thinking process" of men, which appeared in issue No. 82 of the "Philosophy" supplement of Kuang-ming Daily on April 24, is like this. It should be considered as a rather practical method. But I do not quite agree with his basic points of argument and with his analysis of certain examples of dialectics. Dialectic is more than an epistemological principle. More fundamentally, it is a form of praxis — consciousness, selftransformative activity — from which the logical principles of dialectic are then abstracted. Arising in dialog, dialectical praxis is directed toward emancipatory goals through its fidelity to negation. This essay concludes with speculation as to the conditions of nature and human beings that are compatible with the emergence of dialectic.

This paper analyses a hitherto unknown technique of using logic diagrams to create argument maps in eristic dialectics. The method was invented in the 1810s and -20s by Arthur Schopenhauer, who is considered the originator of modern eristic. This technique of Schopenhauer could be interesting for several branches of research in the field of argumentation: Firstly, for the field of argument mapping, since here a hitherto unknown diagrammatic technique is shown in order to visualise possible situations of arguments in a (...) dialogical controversy. Secondly, the art of controversy or eristic, since the diagrams do not analyse the truth of judgements and the validity of inferences, but the persuasiveness of arguments in a dialogue. (shrink)

The author sets out with defining the notions of “muddledness” and “smartness” as two different ways of living. He further emphasizes the practical dimension of the philosophy of life underlying Nande hutu and goes deeper into several concrete domains of application in daily life by referring to historical figures and events. The dialectics of the saying is also (...) illustrated in the two components that Nande hutu is composed of, that is, an active and a passive component. The theory of language that underlies Plotinus’ Enneads is considered in relation to his broader metaphysical vision. For Plotinus, language is neither univocal nor equivocal, but is something in-between, incapable of precisely describing reality, but nonetheless not completely useless. Propositional knowledge expressed discursively represents an imperfect shadow of reality which is defective in relation to the pure apprehension of Intellect. Passages in Plotinus which relate language to the sensible world are examined and it is argued that, although it plays a (...) useful role in relating the sensible world to Intellect, discursive reason is nonetheless intrinsically inferior to both as a mode of representation. Plotinus holds that the inadequacy of language is “global” in character; language cannot describe any aspect of reality precisely, from the mundane to the transcendent. Language as a whole is an inferior image or imitation of the world as a whole. Therefore, the flaws in our linguistic representations cannot all be untangled or conceptually unpacked by means of language. There are passages in the Enneads which hint at an underlying semantic holism. Plotinus’ theory implies that apparent verbal contradictions which occur in different contexts might nonetheless still represent the optimal linguistic description of a reality that strictly speaking is ineffable. Therefore, discursive logical deduction is not always reliable, and needs to be subordinated to a vision of Intellect. True philosophical reasoning (dialectic) represents ostension towards the transcendent. Those who are sufficiently liberated to attain to an apprehension of the Forms, thereby come to inhabit the same “higher world”, involving a shared mystical intersubjectivity, which can be expressed linguistically, but only in an approximate manner. Plotinus’ theory presents a potential way out of the nihilistic impasse into which contemporary philosophy has arguably become enmeshed. (shrink)

This essay presents a careful interpretation of Adorno’s classical text The Essay as Form, published in 1958 as the introduction to his Notes on Literature. Since it thickly condenses many of Adorno’s general views, the Essay poses great hermeneutic challenges to readers. The paper, first, elaborates on the essay more broadly as a genre and identifies a spectrum between science and art each individual essay draws from to forge its particular hybridity. Second, the example is discussed as an epistemologically potent (...) trope oscillating between subsumption and singularity. This internal tension renders the example particularly qualified to serve as the conceptual basis on which interpretative themes in the essay can be discovered. Three lines of interpretation are suggested: poetological for the essay/ Essay’s definition, goal, and method; critical/dialectical for its treatment of concepts and in relation to content; and epistemic for the modern separation of art and science. The purpose of this research review is to examine the usefulness of reconstructing problematic interpersonal conflict behavior as violations of rules for critical discussions. Dialectical reconstruction of interpersonal conflict behavior sheds light on the ways in which dialectical fallacies influence not only the course of a critical discussion, but also the personal and relationship outcomes experienced by arguers. Conflict sequences such as cross complaining and demand/withdraw are shown to be problematic, in part, because they prevent parties from resolving their difference (...) through rational dialogue. In Books V – VII of the Republic we are presented with a picture of knowledge as something entirely distinct from right opinion, and we have described to us a method called dialectic by means of which a suitably endowed person may attain to this knowledge. By knowledge, Plato means knowledge of the forms, although it is far from clear what this really means. And it is also not clear exactly what he means by dialectic, or how it (...) is that dialectic leads to this special sort of knowledge. The key passage, 511b – d, is surely one of the most cryptic passages in philosophical literature, maddening in its suggestiveness. In my talk today I want to risk presenting an interpretation of what Plato might have meant by all of this, and also briefly allude to its broader significance. My key points are these: Dialectic is not just the art of friendly conversation , but a dialogue carried out in a particular way, with a particular end in mind. Plato seemed to want to believe that knowledge of the Forms would allow certain, or necessary analogical reasoning, even though he was uneasy about the obvious impracticability of such a scheme. Problems to be encountered in Plato’s theory of knowledge are indicative of the unresolved tension between the mystical and the rational which existed in Greek thought at this time. Now, the obvious question which strikes the beginner, when he first hears of this notion of dialectic, is, how can mere conversation or debate lead to certain knowledge of the transcendental patterns after which the world is fashioned? It would be very unusual, to say the least, to expect such a remarkable conclusion to any familiar sort of dialectic, such as might, for instance, occur in this seminar room. In fact, it is rare that a philosophical debate (as opposed to a monologue!) comes to any sort of conclusion at all. For instance, we have before us as models.. (shrink)

My dissertation is a critical study of Jose Ortega Y Gasset's attempt to reconcile his notion of lived-experience , which is fundamentally immediate experience, with his idea of life as vital-reason. But life as vital reason is, itself, best understood as consisting of life as a rational-existential project. This, in effect is Ortega's manner of fusing idealism and realism. The result of this mediation is to be interpreted as the self-with-things or what amounts to: I-in-the-world. Man is never what he (...) is in his immediacy and therefore he must create his essence through a self-conscious existential project. Thus, Ortega's notion of life as radical reality is the culmination of an underlying dialectic that is present throughout his work. That is, man's self-awareness of his life as a pre-reflective extranatural phenomenon vis-a-vis the material world can only be understood through reflection and therefore never in its immediacy. Therefore I conclude that for Ortega the synthesis of these apparently antithetical notions culminates in a form of subjective idealism given that primacy is necessarily attributed to the self over the external world. Even though I accept the fundamental tenets of his argument concerning the synthesis of Realism and Idealism and Rationalism and Vitalism, I have focused upon the inherent tension that exists in any such reflective endeavor. I believe that due to Ortega's emphasis that all reflection must originate and therefore concern itself with life as phenomenon, his philosophy necessarily gives primacy to the self over the material world . In arguing "Yo Soy Yo Y Mis Circumstancias" Ortega stresses the character of the Rational Vitalism that results from my self-awareness of my life as a problem for reflection that is forged through my necessary dealings with the world. The result of this self-knowledge is the foundation of a metaphysics of life that is best understood as man as radical reality. (shrink)

_Dialectic_ is now widely regarded as a classic of contemporary philosophy. This book, first published in 1993, sets itself three main aims: the development of a general theory of dialectic, of which Hegelian dialectic can be seen to be a special case; the dialectical enrichment and deepening of critical realism, viz. into the system of dialectical critical realism; and the outline of the elements of a totalizing critique of Western philosophy. The first chapter clarifies the rational core of (...) Hegelian dialectic. Chapter two then proceeds to develop a general theory of dialectic. Isolating the fallacy of 'ontological monovalence', Roy Bhaskar then shows how absence and other negating concepts such as contradiction have a legitimate and necessary ontological employment. He then goes on to give a synoptic account of key dialectical concepts such as the concrete universal; to sketch the further dialectical development of critical naturalism through an account of what he calls four-planar social being; and following consideration of the dialectical critique of analytical reason, he moves on to the real definition of dialectic as absenting absence and in the human sphere, the axiology of freedom. Chapter three extends and deepens critical realism’s characteristic concerns with ontology, science, social science and emancipation not only into the realms of negativity and totality, but also into the fields of reference and truth, spatio-temporality, tense and process, the logic of dialectical universalizability and on to the plane of ethics, where it articulates a combination of moral realism and ethical naturalism, whereby consideration of elemental desire involves commitment to the eudaimonistic society. This is then followed by a sublime discussion of key moments in the trajectory of Western philosophy, the tradition of which can now be seen to be based on what the author calls the unholy trinity of the epistemic fallacy or the reduction of being to knowledge, primal squeeze or the collapse of structure and alethic truth, and ontological monovalence. Often we attribute the sources of this contested place to Hume, and in a more qualified way to Kant. By contrast, Hegel is frequently presented as embodying a post-critical resurgence of metaphysics, a recrudescence of what seemed to have been safely stowed in its grave. True, one finds interpretations in which Hegel as metaphysician is subordinated to Hegel the true heir of the Kantian project. Nevertheless, Hegel's continuity with the prior tradition is so massively evident, and not least in his (...) respect for the Greeks, especially Aristotle, that this interpretation has much to do with the commentators own embarrassments with metaphysics. This paper discusses the character education in Kitab Adab al-‘Alimwa al-Muta’allim, written by one of the founders of largest Muslim organization in Indonesia, Nahdlatul Ulama, Kyai Hasyim Asy’ari as a form of social piety. This book has provided a comprehensive and constructive way of character education which integrates Islamic values with various religious texts. Character education which includes and complements a broad range of educational approaches such as social-emotional learning and civic education shares a commitment to help people become responsible (...) and contributive citizens. Meanwhile, pesantren have taught and built strong characters of the santri in the forms of rabbaniyah, insaniyah, wasathiyyah and waqi’iyyah characters. Therefore, pesantren -based character education the book described is a key element to nurture Muslims’ good habits. This paper shows that the book can be an answer for Indonesia’s contemporary multi-dimensional crises, such as radicalism and terrorism. (shrink)

Over 25 years ago, 1988 to be exact, Maxine Greene delivered the annual John Dewey Lecture. That lecture, “The Dialectic of Freedom,” was the foundation for her book of the same title, also published in 1988 by Teachers College Press. In his foreword to the book, the late Bob Gowin, a philosopher of education at Cornell University, introduced the text with the following:Many dialectics are working in this beautifully written book, and no single formulation will capture the whole. Neither according to Hegel nor according to Levinas is it possible to define the person independently of collectivity. For both, dialogues play a strategic role in the orientation towards the collective. For Hegel, the “good conscience” is significant because it is a reference for describing the assumptions, and the results of a dialogue. I describe these implications in my first section. In the second section, I present Levinas’s objections to the “good conscience.” Instead of a “good conscience,” for Levinas, conscience (...) is an instance that does not confirm the subject but accuses it. In the third section, I explore Levinas’s understanding of dialogue. In his view, dialogue resists a “priority of knowledge” and has an antecedence that points to the common origin of language and ethics. In my conclusion, I describe the resulting intersections and breaks and how a dialogue between Hegel and Levinas can be established against this background. (shrink)

Universal Logic is not a new logic, but a general theory of logics, considered as mathematical structures. The name was introduced about ten years ago, but the subject is as old as the beginning of modern logic: Alfred Tarski and other Polish logicians such as Adolf Lindenbaum developed a general theory of logics at the end of the 1920s based on consequence operations and logical matrices. The subject was revived after the flowering of thousands of new logics during the last (...) thirty years: there was a need for a systematic theory of logics to put some order in this chaotic multiplicity. This book contains recent works on universal logic by first-class researchers from all around the world. The book is full of new and challenging ideas that will guide the future of this exciting subject. It will be of interest for people who want to better understand what logic is. Gilles Deleuze is considered one of the most important French philosophers of the twentieth century. Eleanor Kaufman situates Deleuze in relation to others of his generation, such as Jean-Paul Sartre, Pierre Klossowski, Maurice Blanchot, and Claude Lévi-Strauss, and she engages the provocative readings of Deleuze by Alain Badiou and Slavoj ?i?ek. Deleuze, The Dark Precursor is organized around three themes that critically overlap: dialectic, structure, and being. Kaufman argues that Deleuze's work is deeply concerned with these concepts, even (...) when he advocates for the seemingly opposite notions of univocity, nonsense, and becoming. By drawing on scholastic thought and reading somewhat against the grain, Kaufman suggests that these often-maligned themes allow for a nuanced, even positive reflection on apparently negative states of being, such as extreme inertia. The square of opposition is a diagram related to a theory of oppositions that goes back to Aristotle. Both the diagram and the theory have been discussed throughout the history of logic. Initially, the diagram was employed to present the Aristotelian theory of quantification, but extensions and criticisms of this theory have resulted in various other diagrams. The strength of the theory is that it is at the same time fairly simple and quite rich. The theory of oppositions has recently (...) become a topic of intense interest due to the development of a general geometry of opposition (polygons and polyhedra) with many applications. A congress on the square with an interdisciplinary character has been organized on a regular basis (Montreux 2007, Corsica 2010, Beirut 2012, Vatican 2014, Rapa Nui 2016). The volume at hand is a sequel to two successful books: The Square of Opposition - A General Framework of Cognition, ed. by J.-Y. Béziau & G. Payette, as well as Around and beyond the Square of Opposition, ed. by J.-Y. Béziau & D. Jacquette, and, like those, a collection of selected peer-reviewed papers. The idea of this new volume is to maintain a good equilibrium between history, technical developments and applications. The volume is likely to attract a wide spectrum of readers, mathematicians, philosophers, linguists, psychologists and computer scientists, who may range from undergraduate students to advanced researchers. This paper contributes to those analyses that have discussed Hegel'sinfluence on Freire, and Freire's rethinking of Hegel. Yet, my narrative of the dialectic of conscientizacion, which I presenthere, is a novel attempt to read both thinkers simultaneously.Thus, in this paper I am exploring, and not didactically proving Gadotti's (1994) important, yet unqualified,claim that Hegel's dialectic ``can be considered the principaltheoretical framework of (Freire's) Pedagogy of the Oppressed.It could be said that the whole of his theory of conscientization has (...) its roots in Hegel'' (p. 74). And in thisexploration, I am not demonstrating Freire's ``expansion'' ofHegel's dialectic (Schutte, 1990), nor taking a positionon whether or not the dialectic of Freire's Pedagogy of theOppressed supersedes the Hegelian dialectic (Torres, 1976). Nor am I offering a ``comparison'' of the two dialectics(Torres, 1994). (Of course, having made these claims,I am, as it were, taunting the reader to deconstruct mypiece.) My aim here is to immerse, or insert, myself intothe Freirean/Hegelian dialectic itself. I attempt to situatemyself within that peculiar position of the dialecticianwho ``braids'' ideas through synthetic textual analysis.I use a third person descriptive perspective thatincorporates the ``voices'' of Freire and Hegel, and, thereby, weave a ``new'' synthesized account of theemergence of critical consciousness within the formaleducational setting. The notion of “enaction,” as originally expounded by Varela and his colleagues, was introduced into cognitive science as part of a broad philosophical framework combining science, phenomenology, and Buddhist philosophy. Its intention was to help the researchers in the field avoid falling prey to various dichotomies bedeviling modern philosophy and science, and serve as a “conceptual evocation” of “non-duality” or “groundlessness: an ongoing and irreducible circulation between the flux of lived experience and the search of reason for conceptual invariants, is (...) to function as conceptual evocations of this back-and-forth exchange between knowing and being. However, if this overall framework is discarded, as is often the case in contemporary accounts, enaction loses its radical impetus and becomes mellowed down to yet another version of naturalized epistemology. Implications: Taking the notion of enaction seriously implies a radical shift in our conceptions of science and knowledge, as it encompasses a theoretical and existential move away from a detached observer to embedded and engaged cognizer. Thus, our manner of thinking can no longer be considered in isolation from our manner of being, which indicates a deep interconnection between epistemology and ethics, and may entail profound changes in the definition of the aims, methods, and values of the research community: self-transformation as a consequence of, and condition for, understanding. Constructivist content: The target article advocates a critical approach to realist presuppositions in contemporary science and philosophy, and emphasizes a deep interrelation between being and knowing, between ethics and epistemology. Faced with the exponential development of Big Data and both its legal and economic repercussions, we are still slightly in the dark concerning the use of digital information. In the perpetual balance between confidentiality and transparency, this data will lead us to call into question how we understand certain paradigms, such as the Hippocratic Oath in medicine. As a consequence, a reflection on the study of the risks associated with the ethical issues surrounding the design and manipulation of this "massive (...) data" seems to be essential. In this book, I deal with some fundamental problems of the Hegelian dialectic. For this purpose, I take a middle course between total scepticism, which considers dialectic as a devastator sophistry with no respect even for the non-contradiction principle, and authoritarian dogmatism, which claims to solve any question with the magic wand of the Hegelian Aufhebung. That is, I decide to be critical, defining concepts anew, bringing out sources, determining conditions of possibility and fields of validity, accepting or (...) rejecting when necessary. Following G. R. G. Mure's thinking, from an inner point of view I examine whether, in carrying out his work, Hegel remains faithful to the different principles he proclaims, and I find substantial deviations. And, following W. Becker's thinking, from an external point of view, that is, from a formal, empirical or existential contemporary angle, I try to determine the extent to which we may legitimately talk about the fruitfulness of Hegelian dialectic. In this way, I reconstruct Hegel's thought so that it may become acceptable to us-readers of the twentieth-century-as intelligible and coherent as possible. I conclude that dialectic, as a logic of human reality, has to be grasped and expressed from the viewpoint of the particular historical individual, in constant interaction with the cultural environment of his or her time. Unveiled from its latent status of myth, from the dawn of civilization until nowadays mass media culture as a necessary need of power in a world of intrinsic human powerlessness, an existential condition as antithetical to the latter in the very terms of power signifies the grandest possible of human perspectives to inhere within the state of affairs of a Real certainly vast enough to contain it respecting its unfathomable profundity in space and in time. By focusing accordingly on the (...) significance of this term as a leading determination of the Real, and as a most comprehensive category and ontological criterion in respect to which all other possible meanings, both immanent in character and transcendent, are formed and defined, and on its own embodiment in a personified fashion (as until now indistinctly found in Polytheism and in the overhuman myths only), it reveals itself in its dialectically required status of actual ontological human power, and under this form opposes whatever limitation of the hitherto known and considered human. It consequently also redefines the notion of overhuman, which proves to be thus far incomplete ontologically as still bound to an existential context of ontic impotence (Nietzsche). (shrink)

Universal Logic is not a new logic, but a general theory of logics, considered as mathematical structures. The name was introduced about ten years ago, but the subject is as old as the beginning of modern logic: Alfred Tarski and other Polish logicians such as Adolf Lindenbaum developed a general theory of logics at the end of the 1920s based on consequence operations and logical matrices. The exponential digitization of medical data has led to a transformation of the practice of medicine. This change notably raises a new complexity of issues surrounding health IT. The proper use of these communication tools, such as telemedicine, e-health, m-health the big medical data, should improve the quality of monitoring and care of patients for an information system to "human face". Faced with these challenges, the author analyses in an ethical angle the patient-physician relationship, sharing, transmission and storage of medical (...) information, setting pins to an ethic for the digitization of medical information. Drawing on good practice recommendations closely associated with values, this model is developing tools for reflection and present the keys to understanding the decision-making issues that reflect both the technological constraints and the complex nature of human reality in medicine. Rationality and reasonableness can be illustrated as Janus-faced concepts, not only in a descriptive diagnosis but also in a normative construction of adjudication, and in the analysis of its practical and rhetorical effects. Considering such an illustration, the present reflection returns to the discussion on the relevance of rationality and reasonableness in legal interpretation, aiming at distinguishing and/or connecting principles and criteria, beyond formally logical and/or procedurally argumentative decision-making, and, thus, within a normatively practical adjudication. Such an approach will be (...) presented in two main steps. In a first step, the rationality/reasonableness dichotomy will be discussed within a constitutive connection between principles and criteria in adjudication, and understanding legal principles as normatively substantial foundations to legal criteria—the former as axiological references filtered into the juridical system and the latter as their concretizations, and whose practical adequacy is rhetorically assigned by the interpretive communities involved in/by adjudication, and normatively referred both to their practical accordance to the axiological normativity of the principles they shall presuppose and to their suitability as practical operators to the problematic relevance of the sub judice cases. In a second step, and consequently, encompassing the projection of legal interpretation, in semiotic and in practical-normative perspectives, in order to discuss their constituting practical relevance in adjudication, the rationality/reasonableness dichotomy will be experimented within formal-logical procedures and within practical-dialectical connections between juridical problem and juridical system—therefore stating a discussion on the foundations, the intentionality and the consequences of adjudication, amongst deduction and analogy.
